1. Website Terms and Conditions

Each time you access or use smokefreenorfolk.co.uk you are deemed to accept these terms and conditions.

“we” means Reed Wellbeing Ltd, who provide the Smokefree Norfolk service, and “our” shall be construed accordingly. “you” means the person firm company or organisation browsing and/or using the Website, and “your” shall be construed accordingly. “Reed Corporate Family” means all companies connected with us. A company is connected with us if it is: (i) a subsidiary or holding company of us; (ii) controlled by the same person(s) who control us or our holding company; (iii) a subsidiary or holding company of any company in (i) or (ii) above; or (iv) in the same group as any company under (i), (ii) or (iii) above. “subsidiary” and “holding company” shall be as defined in section 1159 of the Companies Act 2006. The term “control” shall have the same meaning as defined in Section 416 of the Income and Corporation Taxes Act 1988. Two companies are in the same group if they share the same ultimate holding company.

Interruptions and Omissions in Service

Whilst we try to ensure that the standard of the Website remains high and to maintain the continuity of it, the internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. We do not accept any liability arising from any such errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate the Website (or any particular part of it) or to provide the service offered on the Website. We may vary the specification of this site from time to time without notice.

On this site you will be offered automatic links to other sites which we hope will be of interest to you. We do not accept any responsibility for or liability in respect of the content of those sites, the owners of which do not necessarily have any connection, commercial or otherwise, with us. Information Submitted by You

We will and/or the Reed Corporate Family will use information supplied by you to help you access the Smokefree Norfolk service provided by Reed Wellbeing. We will process any data which you provide in completing the online registration or application forms and any further forms, assessments or personal details which you complete or provide to us when using the Website in accordance with relevant data protection legislation. Content Rights

The rights in material on the Website are protected by international copyright, software and trademark laws and you agree to use the Website in a way which does not infringe these rights. You may copy material on the Website for your own private or domestic purposes, but no copying for any commercial or business use is permitted.

Liability

We accept no liability for any loss (whether direct or indirect, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the Website and we hereby exclude any such liability, whether in contract, tort (including for negligence) or otherwise. We hereby exclude all representations, warranties and conditions relating to the Website and your use of it to the maximum extent permitted by law.

You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of the Website.

You must notify us immediately if anyone makes or threatens to make any claim against you relating to your use of the Website.

Choice of Law and Jurisdiction

The use of the Website and any agreements entered into through the Website are to be governed by and construed in accordance with English law. The courts of England are to have exclusive jurisdiction to settle any dispute arising out of or in connection with the use of the Website or any agreement made through the Website.

Some of the goods or services offered through the Website may not be lawful or may otherwise not be permitted in certain countries outside the United Kingdom. If you attempt to order, receive, purchase or otherwise benefit from any such goods or services, we do not accept any liability for any losses suffered by you in using the Website which you would not have suffered had you been accessing the Website as a United Kingdom resident (including as a result of us being prevented from dealing with any application or enquiry by any law, regulation or other ruling applicable in any country).

Changes to Terms and Conditions and Invalidity

These terms and conditions may be changed by us at any time. You will be deemed to accept the terms and conditions (as amended) when you next use the Website following any amendment.

If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

2. Privacy Policy

This Privacy Policy explains how we collect and use personal data about you during and after your participation on our Smokefree Norfolk Service (“the programme”) with us, in accordance with the Data Protection Act 2018 (“DPA”).  In collecting this information and providing the services to you on behalf of Norfolk County Council (“NCC”), we are acting as a data controller.

This notice applies to all service users on this programme. This notice does not form part of any other contract to provide services. We may update this notice at any time but if we do so, we will provide you with an updated copy of this notice as soon as reasonably practical.

It is important that you read and retain this notice, together with any other privacy notice we may provide on specific occasions when we are collecting or processing personal information about you, so that you are aware of how and why we are using such information and what your rights are under the DPA. We only use your personal data for the purposes permitted by NCC in order to deliver the programme.

We may update this notice at any time but if we do so, we will provide you with an updated copy of this notice as soon as reasonably practical.

Who are we?

What information do we collect about you?

NCC have commissioned Reed Wellbeing Limited to deliver the Smokefree Norfolk Service which supports participants to reduce their dependency on tobacco products and stop smoking cigarettes in Norfolk.

The personal data that we collect either directly from yourselves, or from your healthcare provider to deliver the programme includes:

Identity Data includes names, marital status, title, date of birth, age, nationality, NHS number, pregnancy status and gender.

Contact Data includes home address, email address and telephone numbers and contact details for your next of kin or emergency contact/carer.

Special Categories of Personal Data includes details about your race or ethnicity, mental health conditions, sexual orientation, and information about your health including disability.

Anonymised outcomes of the programme will be shared securely with Norfolk County Council

Third Parties

Reed in Partnership Limited provide business services to RW and have access to process your data in order for Reed in Partnership to provide business services.   We may also share your personal data with third party service providers who assist us in carrying out our business activities. These third parties act as our data processors and are bound by strict contractual provisions to only process your personal data under our instructions and for the limited purposes we permit them. These third parties include (but are not limited to) evaluation, research and market research and analysis service providers, and all other outsourced service providers (such as communication providers) that assist us in the provision of our services.

We may also share your personal data with courts, tribunals, regulators and other governmental and public authorities (such as the police or tax authorities) to: (i) to comply with legal process, (ii) to comply with applicable law, and (iii) to respond to requests from public and governmental bodies.

We do not share your personal data with any other third parties, apart from where it is necessary to do so in order to deliver the programme as described above, and we will never sell your data. Where your data is stored (electronically or otherwise) it is held securely in the UK and will not be transferred outside the EEA.

Why do we collect this information?

We only collect this data because it is required to deliver the programme on behalf of Norfolk County Council. It is therefore needed to perform a task that is accrued out in the public interest, which in this case is the provision and management of a health and social care system and service.

Any data which is collected by RW which is not prescribed by Norfolk County Council is collected under the grounds of legitimate interests, as without this information, RW would be unable to provide you with the service and support you require in order to partake in the programme.

In order to provide you with additional support, we may also ask for your consent to share your personal data with a network of organisations. The consent form will provide you with the ability to control the personal data you are prepared to share as well as the organisations you are prepared to share it with. You are able to withdraw your consent at any time.

What do we do with your information?

We only use your personal data to deliver the programme to the standard required by NCC, for audit purposes and to track the effectiveness of our service delivery.

It will also be used to confirm your progress on the Programme. Your personal data will only be shared with such organisations to the extent that it is necessary to deliver the programme.

How long do we keep your information for?

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you. Once we are no longer contractually required to keep your data we will securely destroy your personal information in accordance with our Retention Policy.

Your rights over your information

By law, you can ask us what information we hold about you, and you can ask us to correct it if it is inaccurate. Under certain circumstances you have the right to request that we either delete or restrict the processing of your personal data or can request the transfer of your personal data.
